TERMS AND CONDITIONS OF USE AND PRIVACY POLICY FOR PORTFI CHARGING LITE APP

Introduction

1. PortFi Charging Lite app is an electric vehicle (EV) charging app developed by PortFi, LLC. These terms and conditions govern your use of the PortFi Charging Lite app. By downloading and using the app, you agree to be bound by these terms and conditions.

Registration

2. To use the PortFi Charging Lite app, you must use the dedicated link provided by PortFi, LLC, or register and create an account. You agree to provide accurate and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account information, including the dedicated link provided by PortFi, LLC, your password, serial number, and order number. You must immediately notify PortFi, LLC if you suspect any unauthorized use of your account.

Service

3. The PortFi Charging Lite app allows you to monitor and control your PortFi EV charger. You acknowledge that the app may not always be available or error-free. PortFi, LLC reserves the right to modify, suspend or discontinue any aspect of the app at any time with or without notice. PortFi, LLC may, with or without notice to the users, conduct diagnosis, maintenance, and software update of the app, app's connection to charger, charger management platform, charger firmware, backend services, or databases. 

User Conduct

4. You agree to use the PortFi Charging Lite app only for its intended purposes and in compliance with these terms and conditions. You agree not to use the app for any unlawful or prohibited activity, including but not limited to: (a) interfering with or disrupting the app or servers or networks connected to the app, (b) using any automated means to access the app or its backend services, (c) attempting to impersonate another user or person, or (d) transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.

Intellectual Property

5. The PortFi Charging Lite app and all content and materials contained in the app are owned by PortFi, LLC or its licensors, including but not limited to Matt Zabriskie & Collaborators, Scott Motte, Gareth Hughes, TJ Holowaychuk, Roman Shtylman, Douglas Christopher Wilson, LearnBoost, Apollo Graph, Jonathan Ong, Jeff Mott, Evan Vosberg, Yahoo Inc., GraphQL Contributors,  and are protected by intellectual property laws. You agree not to use, copy, modify, or distribute any content or materials from the app without PortFi, LLC's and its licensors' prior written consent.

Disclaimer of Warranties

6. THE PORTFI CHARGING LITE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PORTFI, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. PORTFI, LLC DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

Limitation of Liability

7. IN NO EVENT SHALL PORTFI, LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF THE USE OR INABILITY TO USE THE PORTFI CHARGING LITE APP, EVEN IF PORTFI, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

8. You agree to indemnify and hold harmless PortFi, LLC and its affiliates, officers, agents, and employees from any and all claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the PortFi Charging Lite app or your breach of these terms and conditions.

Governing Law and Jurisdiction

9. These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction where PortFi, LLC is located, without giving effect to any principles of conflicts of law. You agree that any action or proceeding arising out of or related to these terms and conditions
